Final Reminder: What You Need to Know Before Closing a Deal in Spain

You’ve chosen a property and are ready to buy. All that’s left is signing the contract. Congratulations—you’re almost there! But before you sign in front of the notary, it’s important to make sure everything is in order. Here’s a brief checklist that we always review with clients before closing.
1. Legal cleanliness of the property:
Has a lawyer checked the property?
- Ownership is confirmed.
- There are no outstanding debts related to utilities, mortgages, or taxes.
- The land use designation and licenses are in order.
You have a copy of the Nota Simple, an official extract from the property registry.
If you are purchasing an off-plan property that is under construction, the developer’s license package and bank guarantee (aval bancario) have been verified.
2. Financial calculations:
- You clearly understand the final total amount, which includes the property price, taxes, notary fees, and registration fees.
- All expenses are calculated and documented in writing.
- You have proof of the funds transfer, such as a receipt, order, or bank transfer.
- The reservation and deposit have already been paid, if applicable.
3. Your documents
You have on hand:
- Your valid passport,
- NIE (foreigner’s tax identification number), or a power of attorney to obtain it.
- A Spanish bank account number (if payment will go through it);
- Copies of all documents sent to your lawyer or agency.
4. Notary Appointment
- You have a scheduled appointment with the notary. An interpreter will be present if you don’t speak Spanish.
- You have received the text of the escritura pública, or notarized purchase agreement, in advance.
- All documents for registration in the Property Registry have been prepared.
- If you are buying by power of attorney, it has already been prepared and accepted by the notary.
5. What Happens After Signing
The keys are handed over immediately or at a later agreed-upon time.
The agency takes care of:
- Registration of the property title,
- Transferring utility contracts to your name.
- Assistance with a tax representative (if you’re a non-resident);
- Ongoing management, repairs, and rentals are provided if needed.
6. Important: Do not sign anything you do not understand.
If anything is unclear, ask. It’s your right. We will explain every clause of the contract, every figure, and every procedure so that you have no doubts.
